from a legal perspective.
ADVICE
“The Government via building control have issued a document
called Part L that came into effect in April 2002. This new regulation
will mean that all replacement windows, roof lights and glazed doors
installed after this date, must now comply with building regulations
and have a Certificate to that effect. Thus ensuring the consumer is
receiving the most efficient thermal insulation, safety glazing, emergency
fire escape and a control on the installer’s standards. Individuals
failing to meet this standard can be fined up to £5000.”
HOW IT AFFECTS YOUR SALE AND PURCHASE
“As solicitors, we strongly recommend that property owners make
sure that the work is carried out by a FENSA member or you have registered
in advance via building control
When you sell your property your solicitor will ask you to produce the
Certificate and any Guarantee. If these documents are missing, a verbal
confirmation is insufficient and replacement documents would have to
be obtained, thus you run the risk of delay and extra expense.”
You should keep the documents carefully with any other building regulation
consent or planning permission, and any correspondence with the local
authority about any work or extension to your property. If you have
your paperwork in good order, that will help your solicitor to deal
with your sale quickly.
When you buy your property your solicitor should ask specifically whether
any glazing work requiring a certificate has been carried out since
1st April 2002 and advise you accordingly. If you are aware of any such
work , you should tell your solicitor about it.” Bennetts can
